Abstract

Kant's account of global justice can be tested against some contemporary phenomena. Consider, for instance, the issue of regulatory capture in relation to environmental policy; how would Kant's moral philosophy (including ethics and politico-juridical thinking) deal with this problem? Would there be room within the Kantian conceptual framework to account for what is wrong with this issue and would such an account be plausible? Consider, in addition, the issue of constitutionalisation in international law, in particular, the way trade agreements may overlook democratic choice or even human rights in pursuit of benefits for the parties to the agreement; would Kant's legal philosophy be able to respond approripately to such a situation? The relevance and limits of Kantian thought, particulary about globsl justice, can also be examined by comparing the Kantian view of global order with alternative accounts. For example, an interesting comparative investigation would focus on the Tianxia model of global order and would evaluate the extent to which it would be preferable to the Kantian model. Another interesting question would start from Rawls's Kantian theory, in particular his understanding of Kant's formulations of the Categorical Imperative; the question would concern the extent to which the normative core of Rawls's understanding of Kant finds a proper place in today's political theory and international political theory. Papers in this panel will address these themes and questions.
